Terms of Service

01The agreement

These terms are an agreement between you and ForgeCast, which is run by an individual based in India ("we", "us"). They cover the ForgeCast desktop app, the website at forgecast.in, the marketplace, plugins, AI features and the API (together, "ForgeCast").

By creating an account, downloading the app or using ForgeCast you agree to these terms, our Privacy Policy, Refund Policy and Cancellation Policy. If you don't agree, please don't use ForgeCast.

02You and your account

• You must be 18 or older, or have a parent or guardian accept these terms for you. You also need to meet YouTube's own age rules.
• You sign in with Google or Discord. Keep that account secure: you are responsible for what happens under your ForgeCast account.
• One person, one account. Don't share or sell accounts, or make accounts to get around plan limits.
• Tell us straight away at support@forgecast.in if you think someone else has used your account.

03What ForgeCast is

ForgeCast helps YouTube streamers with overlays, alerts, live chat, chat actions, sounds, stats and more. It works with services we don't control, mainly YouTube and OBS Studio. When they change or go down, parts of ForgeCast may stop working until we catch up; we'll do our best, but we can't promise any feature will work with them forever.

We keep improving ForgeCast, so features may change, move between plans or be removed. If we remove something you pay for in a way that matters, we'll tell you first and you can cancel and ask for a refund of the unused part.

04Plans and payments

• The Free plan costs nothing. Pro and Ultimate are paid subscriptions, charged in advance each month, at the prices shown on the pricing page when you buy.
• Prices are shown in Indian rupees for India and US dollars elsewhere. Your bank may convert currencies at its own rate. Taxes such as GST are added where the law requires.
• Subscriptions renew automatically until you cancel. You can cancel any time: see the Cancellation Policy.
• Your first payment for a plan can be refunded in full within 7 days: see the Refund Policy.
• If we change a plan's price, we tell you at least 30 days before it applies to you, and you can cancel before then.
• Payments are handled by Razorpay (Razorpay Payments Private Limited); their terms also apply to the payment itself. We never see or store your card or bank details.

The ForgeCast team may also give a paid plan instead of it being bought. Such a plan ends on the date we give you.

05Beta builds and early features

Beta builds, Beta Lab features and anything marked as early access are for trying new things. They may have bugs, change or disappear, and we offer them as they are. Don't rely on them for anything critical, and keep backups of what matters to you.

06Your content

You own what you make and upload: overlays, pictures, chat actions, plugins and so on ("your content"). You give us a worldwide, non-exclusive licence to store, copy, show and process your content only as needed to run ForgeCast for you, and, for things you choose to publish in the marketplace, to show and distribute them to other users.

You must have the rights to everything you upload. Don't upload content that infringes anyone else's copyright, trademark or privacy.

07Marketplace items

Overlays, widgets, themes and plugins in the marketplace are licensed, not sold. While you have an account (and the plan an item needs), you may use them on your own streams and recordings, including monetised ones, and customise them where ForgeCast lets you.

You may not resell, redistribute or share marketplace items or their artwork outside ForgeCast, or claim them as your own work.

If you publish items yourself, you confirm you have the rights to them and that they follow these terms. We may review, refuse or remove listings.

08Plugins

Plugins are small programs that run in ForgeCast on your computer, with the permissions you approve. Plugins marked "Verified" are made or checked by us. Plugins marked "Community" are made by other people and we don't review all of them: install them only if you trust their maker, and check what they ask for.

If you write plugins, follow the plugin documentation and don't make plugins that harm users, collect data they didn't agree to, or try to escape the permissions they were given.

09AI features

• AI features use Google's Gemini models. Their answers can be wrong or unsuitable: check them before you use them, especially anything posted to your audience.
• Each plan includes a number of AI credits a month. Credits have no cash value and can't be transferred.
• Don't send AI features anything you don't have the right to share, or sensitive personal data.
• You are responsible for how you use what an AI feature gives you.

10YouTube and other services

ForgeCast uses YouTube API Services. By using its YouTube features you agree to be bound by the YouTube Terms of Service. Google's use of your data is covered by the Google Privacy Policy.

ForgeCast is not affiliated with or endorsed by YouTube, Google, the OBS Project, Discord or any other service it works with. Your use of those services is governed by their own terms.

11Acceptable use

When using ForgeCast, don't:

• break the law, YouTube's rules or anyone else's rights;
• upload or broadcast content that is hateful, harassing, sexually explicit involving minors, or meant to deceive or defraud;
• try to break into, overload, scrape or reverse-engineer our servers, or get around plan limits, credits or security;
• use the API or automation to spam chat or other people;
• resell ForgeCast or access to it without our written permission.

12The API

You can use the ForgeCast API with the keys in your account, within the rate limits of your plan and the API documentation. Keep keys secret. We may change the API with reasonable notice, and limit or revoke keys that are abused.

13Our property

ForgeCast, its name, logo, software, designs and documentation belong to us or our licensors. Apart from the rights these terms give you, nothing is transferred to you. The desktop app is licensed for your own use; don't copy, modify or redistribute it except as the law allows.

14Suspension and ending

You can stop using ForgeCast and delete your account at any time under Settings.

We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Where we reasonably can, we'll warn you first and explain why. If we close ForgeCast altogether, we'll give at least 30 days' notice and refund the unused part of any paid period.

15No warranty

We work hard to make ForgeCast reliable, but it is provided "as is" and "as available". As far as the law allows, we don't promise it will be uninterrupted, error-free or fit for every purpose, and we aren't responsible for problems caused by YouTube, OBS, your computer, your internet connection or plugins made by others.

16Limits on liability

As far as the law allows, we aren't liable for indirect or consequential losses, such as lost income, lost viewers or a stream that went wrong. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or ₹1,000 if that is more.

Nothing in these terms limits liability that the law doesn't allow to be limited, or your rights as a consumer.

17Your responsibility

If someone makes a claim against us because of your content, your stream or your breach of these terms, you agree to cover the reasonable costs we face as a result, as far as the law allows.

18Changes to these terms

We may update these terms. If a change matters, we'll tell you by email or in the app at least 15 days before it applies (sooner only if the law or security requires it). If you keep using ForgeCast after that, the new terms apply; if you don't agree, you can cancel and delete your account.

19Law and disputes

These terms are governed by the laws of India. If there is a problem, write to us first: most things can be sorted out quickly. Otherwise, disputes go to the courts of India, without taking away any right you have to bring a claim where you live.
